Change to employment contract

A man in his late sixties came to seek employment advice. He had worked hard all his life delivering school meals and the contract had been taken over by a private contractor. They had given him a new contract but, as he was semi-literate, he could not read it.  His wife tried to help but could not understand what was written.

The employer had refused to pay sick pay and holiday pay, claiming that he was not entitled to these, saying this was either because he was above retirement age or because his contract stated he was employed “as and when”.

Law For All was able to help simply by checking and explaining his contractual and statutory rights and he decided to approach the senior managers himself to ask for an explanation of his treatment.
