Disability discrimination

One of Law For All’s clients is the aunt and guardian of an 11-year-old boy with a prosthetic leg. One of his teachers, annoyed at his failure to fetch her register one morning, told him that God had punished him by making him like that and mimicked his walk, in front of the child himself and other pupils.

The boy complained immediately to one of his other teachers and his aunt complained to the head teacher the following school day. However, the school failed to look at CCTV footage of the corridor and when the teacher was subsequently interviewed some time later, it was decided that no further action could be taken as there was “no evidence” to support the complaint.

The boy was so distressed by the incident that he was unable to attend school for several weeks. He then felt able to return but has now been placed in a technology class with the teacher in question.

Law For All has agreed to take a claim free of charge to the tribunal to claim breach of the Disability Discrimination Act and ask for the teacher to receive appropriate training.
