Tricked into debt

In 2001 one of Law For All’s clients had been persuaded to sign a document by her then partner.  He said it was a reference for his son.  However, some years later the client began to receive demands from a debt collection agency and it transpired that the document had been a guarantee for a loan of £2,000.  The ex-partner’s son had not made the necessary repayments and our client was being pursued for the debt.  Law For All is challenging the validity of the guarantee, as the lender should have been aware of the possibility of undue influence and ensured that the client had independent advice before signing the document.
